Ništavni ugovor
Najavljeno potpisivanje tzv.
Temeljnoga ugovora sa SPC uzburkalo je javnost sa pokudama i podrškom.. Dugo se
nije znalo što sadrži. Svakako je oprečan interesu sekularne crnogorske
Crne Gore. Premijer Abazović potvrđuje da će svakako biti prihvaćen, usklađen
sa Ustavom i zakonima Crne Gore. U TU ne vidi ništa sporno!? Sa kakvom
Crkvom „Pozivajući se
na međunarodno pravo” država Crna Gora kani da potpiše ugovor?
Temeljni ugovor se temelji na krivotvorinama kojima
obiluje Srpska crkva u posrbljivanju i posvajanju svega crnogorskoga u razvoju
Duklje/Zete/Crne Gore. Prethodno: Polazeći od činjenice Hrišćanska Crkva
na prostoru današnje Crne Gore postoji od apostolskih vremena sa kontinuitetom
kroz istorijsko pravoslavno i crkveno ustrojstvo od osnivanja Zetske eparhije. Opažam:
Srpska crkva, znači, seže do apostolskih vremena?! Mjesto
činjenica nudi krivotvorine zasnovane na tvrdnjama Mitropolita Mitropolije
crnogorsko-primorske SPC da Srpska crkva ima kontiniuitet: da je Hristova crkva koja postoji na prostorima današnje Crne Gore još od
4. vijeka u živome, naravno srpskome, crkvenome kontinuitetu, po kojemu vikarni
episkop Metodije (Durmitorac) nosi titulu dioklijskoga episkopa. Poliglota i dr
nauka pobrkao je: u velikoj Seobi naroda Južni Sloveni naseljavaju Balkansko
poluostrvo u VI, preci Crnogoraca, i u VII vijeku, preci Srba. Nikako nije
mogla nepostojeća Srpska crkva da bude u kontinuitetu sa hrišćanstvom IV
vijeka. da je Zetska episkopija na
Miholjskoj prevlaci današnja pravoslavna Mitropolija
crnogorsko-primorska i episkopije koje je osnovao prvi arhiepiskop srpski Sveti
Sava (1219. godine) prije 800 godina, poslije osnivanja samostalne
(autokefalne) Žičke arhiepiskopije, i danas živuće. da je „Mitropolija (=crkva)
zetska (je) od ukidanja Pećke patrijaršije (1766. godine), kao čuvarka njene
autokefalnosti (zajedno sa Karlovačkom mitropolijom) postojala
samostalno“.
Činjenica: Propašću srednjevjekovne
srpske države nestaje i Svetosavska crkva u Zeti/Crnoj Gori. da je „Zajedno sa ostalim
pomjesnim crkvama, djelovima nekadašnje Pećke patrijaršije, ona (je) bila prva
među njima koja je obnovila jedinstvenu Pećku patrijaršiju (1918-1922. godine).
Primjećujem: Nemoguće je da nepostojeća srpska Mitropolija obavlja obnovu. da je ona
blagodareći crnogorskim mitropolitima i gospodarima Petrovićima stvorila
nezavisnu Crnu Goru. Ona je (za vrijeme knjaza Nikole) nazivana i autokefalna,
iako nije ni od koga tražila ni dobila autokefalnost, što je tačno ali za
Crnogorsku crkvu. (Amfilohije: Crkva je
Božija, a ne crkva bilo koje države ili nacije, Pobjeda, 12. 08. 2019)
U mojim knjigama o crnogorskoj naciji, i sada
pripremljenoj za štampu Crnogorska
državotvornost: u/na izvoru dokazujem činjenicama da je nezavisnu Crnu Goru
stvorio crnogorski narod/nacija.
Premijer Dritan Abazović
traži da se manemo prošlosti a usredsredimo na budućnost. Kao Premijer može
govoriti po nahođenju, ali je kao doktor političkih nauka obavezan da poštuje i
naučne činjenice i dokaze. I za najavljeni Ugovor potrebno je da ima dovoljna
znanja da bi mogao valjano da ocjenjuje i odlučuje. Hiljadugodišnja prošlost
Crne Gore nije samo prolazna nego svevremena, sa velikim vrijednostima koje je
stvarala i obistinila u trajno nasljeđe. Istorija svjedoči: Najstarija
crnogorska država, Duklja prva je nezavisna država jugoslovenskih naroda.
Međunarodno priznata država 1077. godine, 140. godina prije Srbije, kada se
papa Grgur VII 9. I 1078. godine obraća Mihailu Vojislavljeviću kao Michaeli Sclavorum regi. Tako je i sa
Crkvom koja je bivstovala u Duklji, prije raskola, i poslije
1054. Katolička biva i poslije raskola na rimo-katoličku i grčko-katoličku
(ortodoksnu, pravoslavnu) crkvu. „Kulturno i religijski bila je u sferi Rima i
onda kada je bila pod vizantijskom okupacijom“. Do okupacije Duklje/Zete od
Nemanjića i njihovih nasljednika, kada je zavedena episkopska pravoslavna crkva
Save Nemanjića, do pada Srbije pod Osmanlijsko carstvo, i pripadnost Pećke
Patrijaršije sistemu osmanlijske vlasti do konačnoga ukidanja.
U vrijeme vladavine Balšića bila je uveliko katolička crkva. Novi veliki događaj nastaje
osnivanjem samostalne Crnogorske crkve Odlukom Ivana Crnojevića 1485. godine. U
Osnivačkoj povelji Cetinjskoga
manastira od 4. januara 1485. godine gospodara Ivana Crnojevića, istovremeno
osnivača samostalne Crnogorske/Zetske) mitropolije, odnosno autokefalne
Crnogorske crkve, obznanjeno je: „I ogradih hram u mjestu koje se zove Cetinje
u slavu u hvalu te Gospođe i Majke Božje, u ime Njezina Roždestva. I napravih
pri njemu manastir za upokojenje monaha i nazvah ga Mitropolijom zetskom, ako
bude ugodno milostivoj Gospođi. I postavih tu mitropolita zetskoga kir
Visariona, koji je bio u to vrijeme, da vlada svim a poslijed njega [njegovi]
nasljednici. I priložih tome svetome hramu koliko mi bi moguće...“. (Sazdanje Cetinja, izvori i legende,
priredio dr Radoslav Rotković, Leksikografski zavod Crne Gore, Titograd 1984,
str. 61-63) Otada, pa sve do nelegalne i
nelegitimne Podgoričke skupštine, koja je svojom Odlukom suprotnoj Ustavu Crne
Gore i međunarodnome pravu, ukinula nezavisnu državu Crnu Goru, i sljedstveno
autokefalnu Crnogorsku crkvu, koja je pripojena novoosnovanoj Srpskoj crkvi.
Crnogorska crkva je bila autokefalna po Ustavu Crne Gore, priznata od
Vaseljenske patrijaršije. Ukinuta odlukom Podgoričke skupštine. Valja znati, i
ponavljati, da su krivotvorine sve tvrdnje da Srpska pravoslavna crkva stoluje
800 godina, da je ona stvorila Crnu Goru i da ima pravo na sve crnogorsko, koje
proglašava za – srpsko!?
Zna se da je i Srpska pravoslavna crkva, koja je proslavila
800-godišnjicu postojanja, nekanonski postala samostalna episkopija, vještinama
Rastka/Save Nemanjića, uz obilatu novčanu naknadu, bez pisanoga tomosa. Tomos
nije mogao dobiti bez saglasnosti Ohridske patrijaršije pod čijom jurisdikcijom
je potpadao. Ohridski parijarh Hromatijan žestoko se tome usprotivio. (Radoslav
Rotković, Velika zavjera protiv Crne Gore,
Nevladina organizacija Crnogorska izdanja - Montenegro editions, Podgorica 2001,
isto, str. 610) SPC, svejedno kako se zvala, od početka je
okupatorska crkva. Osnivala je eparhije u Zeti nakon pokoravanja „ognjem i
mačem“, koje je izvršio imperijalni osvajač Stefan Nemanja: „U
Dioklitiji/Duklji poruši sve gradove: Danj, Sardoniki, Rosaf zvani Skadar,
Svač, Ulcinj, grad slavni Bar, osim Kotora, u koji prenese svoj dvor“. (Život Stefana Nemanje od kralja Stefana
Prvovenčanog, Stare srpske biografije,
Srpska književna zadruga, Beograd 1924, str. 41-42)
Koja je neobuzdana sila gonila Nemanju da ruši
sve pred sobom? Zar nije bilo umjesnije da se sačuvaju gradovi nego da se
pretvaraju u „prah i pepeo“? Ili se tako potirao svaki trag pređašnjoj državi,
dinastiji, etnosu, kulturi...! U upotrebi, od AB
revolucije, prema trenutnoj potrebi, nazivi su: Cetinjska Mitropolija, Srpska
pravoslavna crkva, Srpska Cetinjska Mitropolija, Mitropolija
crnogorsko-primorska. U suštini, po uređenju i po djelovanju eparhija je Srpske
pravoslavne crkve u okviru Beogradske patrijaršije. U matičnoj
državi, kontinuitet stiče tek 1836. godine. Po statusu crkve u Srbiji, koja je
1836. godine bila samo autonomija u Otomanskoj državi, Beogradska mitropolija
mijenja ime u Pravoslavna crkva Kraljevine Srbije. Bitan je član 11 Zakona o
verskim zajednicama Republike Srbije (iz 2006. godine): „Srpskoj Pravoslavnoj
Crkvi priznaje se kontinuitet sa pravnim subjektivitetom stečenim na osnovu Načertanija o duhovnoj vlasti (Odluka
Narodne Skupštine Knjaževstva Srbskog od 21. maja 1836. godine) i Zakona o
Srpskoj Pravoslavnoj Crkvi („Službene novine Kraljevine Jugoslavije“, broj
269/1929)“. U Zakonu piše da je 1929. godine SPC dobila svoje današnje ime. Predloženim
Ugovorom ruši se suverenost i teritorijalna cjelokupnost Crne Gore. Suprotni su
članovi 2 i 8 koji ozakonjuju kontinuitet SPC i koji crnogorske crkve i
manastire u svojini nezavisne države Crne Gore i korišćenju autokefalne
Crnogorske crkve upisuju u vasništvo SPC u Crnoj Gori. Sporim član 2 po kojemu: “Država
priznaje kоntinuitet pravnоg subjektiviteta i u skladu sa svоjim Ustavоm jemči
Crkvi i njenim crkvenо-pravnim licima (eparhijama, crkvenim оpštinama,
manastirima, zadužbinama, samоstalnim ustanоvama i fоndоvima i, prema crkvenоj
namjeni, pоjedinim hramоvima) vršenje javnоpravnih оvlašćenja u Crnоj Gоri u
skladu sa pravоslavnim kanоnskim pravоm i Ustavоm SPC”. U skladu sa osporenim
svakim kontinuitetom, pogotovu je netačan pravni, koji na načelu da je
Srpska crkva zaslužna i u vrijeme vladika Petrovića, predaje cjeloupnu državnu
svojinu Crne Gore i autokefalne Crnogorske crkve do 1918. godine u posjed
Srpske Crkve i države Srbije.
Suština jeste: Čiju imovinu predaju u vlasništvo i upravljanje tuđoj
crkvi, svejedno koliko vjernika ima? Podsjetiću: Nadležna crkvena vlast ima pravо da
samоstalnо uređuje njezinu unutrašnju оrganizaciju i da оsniva, mijenja, ukida
ili priznaje crkvenо-pravna lica prema оdredbama pravоslavnоg kanоnskоg prava i
Ustava SPC. U članu 7 “Država jemči Crkvi
slоbоdu bоgоsluženja, vjerskih оbreda i оstalih vjerskih i humanitarnih
djelatnоsti”. Međutim, nastavlja da potvrđuje crkvenu svojinu i objektima koji
su kulturno.duhovno blago Crne Gore, istovremeno “i na javnim mjestima, оtvоrenim
prоstоrima i mjestima vezanim za značajne istоrijske dоgađaje ili ličnоsti”. Vrhunac: “Država jemči Crkvi nepоvredivоst
prava svоjine i državine nad manastirima, hramоvima, zgradama i drugim
nepоkretnоstima i prоstоrima u njenоm vlasništvu, u skladu sa pravnim pоretkоm
Države. Država se оbavezuje da, u skladu sa sоpstvenim pravnim pоretkоm, izvrši
uknjižbu svih neupisanih nepоkretnоsti u vlasništvо Mitrоpоlije
crnоgоrskо-primоrske, Еparhije budimljanskо-nikšićke, Еparhije mileševske,
Еparhije zahumskо-hercegоvačke i njihоvih crkvenо-pravnih lica kоjima
pripadaju”. Država ne brine kako je Crkva stekla nepоvredivоst prava svоjine i
državine nad manastirima, hramоvima, zgradama…” Niko nema pravo da crnogorsku imovinu,
crnogorsko kulturno-duhovno nasljeđe, crnogorske manastire i crkve preda u
posjed druge države, preko crkve kojoj je Srbija matična država, a središte
Srpska patrijaršija sa sjedištem u Beogradu. (Podsjećam: Ukupna površina
nepokretnosti upisana na Mitropoliju crnogorsko-primorsku, odnosno SPC, iznosi
više od 11 miliona kvadratnih metara. U tome više od 60 hiljada kvadrata
čine 523 objekta, dok su ostalo pašnjaci, šume, zemljišta…Svu navedenu imovinu
(izuzev novih objekata) uzurpirala je i okupirala Srpska pravoslavna crkva od
1918. godine nezakonitim i nekanonskim putem. Učinjena su tri akta nasilja
prema Crnogorskoj crkvi: nasilno ukidanje Crnogorske države 1918. godine, ukaz
Aleksandra Karađorđevića o ujedinjenju crkvenih oblasti 1920. godine i Ustav

Valjalo je odmah, naveo sam
u tekstu SPC u Crnoj Gori država u državi,
pomno i podrobno raspraviti ko je/kako/zašto zakonom iz 1997. godine omogućio
da se imovina Crnogorske crkve upiše u vlasništvo Srpske pravoslavne crkve. U
izmaku tzv. AB revolucije vjerovatno se ugrabilo da se izvede takav čin. Ništa
nije preduzeto. I sada je pitanje: Ko je tada, ima li ga u tadašnjoj
vlasti, bio vinovnik i izvršilac nepravde?
Masovne litije sa
poklikom: Ne damo svetinje samo su
potvrdile amfilohijevsko posrbljivanje crnogorskoga kultrurno.duhovnoga
nasljeđa. Uzvratno nije bilo nikakvih protesta sa uzvikom da se vrate
crnogorske Otete svetinje. Gradili su
ih preci Crnogoraca čiji potomci danas nemaju pravo na svoje crkve i manastire.
Vuk St. Karadžić svojevremeno svjedoči: “U Crnoj gori ima dosta crkava; svako
pleme ih ima po nekoliko, a svako selo bar po jednu. I manastira ima u svakoj
nahiji, ali nema u svakoj kaluđera, već su ili vladičini ili nahijski”. (Vuk

O Crnoj Gori, Prosveta-Nolit, Beograd
1987. godine, str. 325) Nije
prihvatljivo da u sekularnoj Crnoj Gori Srpska crkva dobija status države
pregovarača o uređivanju međusobnih odnosa. Neprikladno je poređenje sa Katoličkom crkvom i
Islamskom zajednicom, pošto ne posjeduju crnogorska kulturno-duhovna dobra
kojima samostalno raspolažu, i nemaju matične države kojima su
pripadne. Protivustavan
je svaki ugovor države Crne Gore koji daje teritoriju i kulturno-duhovna dobra
Crne Gore u posjed Crkve druge države. Pravoslavne crkve su pomjesne/nacionalne
i djelatne u državi čije ime nose. Mogu imati svoje ispostave i u drugim
državama, ali ne sa pravima matične crkve. One se bave samo vjerskim poslovima.
Neprihvatljivo je da Srpska crkva u Crnoj Gori bude, kako se ponašala u vrijeme
mitropolita Amfilohija, država u državi, držav protiv države, država
iznad države, država izvan države, što sam ustvrdio i dokazao u posebnome

Zakon koji je donijela tzv.
apostolska Vlada O slobodi
vjeroispovijesti, poništavajući Zakon koji je usvojila prethodna Skupština,
nije valjani dokaz za proizvoljno tumačenje i nasilno otimanje, prisvajanje i
prenošenje crnogorske imovine u posjed druge države. Nema nikakvo utemeljenje u
Ustavu Crne Gore. Sve crnogorske
crkve i manastiri moraju biti otvoreni za sve vjernike. U svojini su države
Crne Gore koju daje vjerskim zajednicama na korišćenje. Makar izgledalo da
formalno potpisivanje Temeljnoga ugovora
ima zakonsko opravdanje, praktično je nasilno oduzimanje crnogorske imovine i
kulturnih dobara.
Niko nema pravo, svjedno
koliku i kakvu vlast imao, i kako opravdavao, da potpiše Temeljni ugovor sa Crkvom koja ne priznaje nezavisnu
Crnu Goru, poriče crnogorsku naciju, crnogorsku kulturu, autokefalnu Crnogorsku
crkvu, teži ujedinjenje svih Srba u Srpski
svet, pa Veliku Srbiju.

Utuk na Temeljni ugovor učinio
sam mjesec dana prije nego je usvojen. Niko nije hajao. Na godišnjicu
potpisivanja Temeljnoga ugovora
Dritan Abazović pohvaljuje sebe. Zagubljen, i zadivljen, u svome bezobrazluku,
ništa nije shvatio. “Predstavlja mi životnu čast što sam zajedno sa Patrijahom
SPC Porfirijem, kojem dugujem posebnu zahvalnost, kao i mitropolitu Joanikiju i
ministru pravde Marku Kovaču, stavio potpis na Temeljni ugovor. Tim činom
zajednički smo učinili da se otvori nova stranicu odnosa države Crne Gore i
većinskog pravoslavnog stanovništva…” Vrhunac: Tvrdim da je potpisivanje Temeljnog
ugovora akt kojim je Crna Gora dobila perspektivu za najsvjetliju budućnost i
utrla put mnogim demokratskim procesima koji su se desili nakon toga. Test
vremena je već položen. Zahvalnost pripada Bogu”. (Godinu dana od potpisivanja Temeljnog ugovora) Kojemu, čijemu, kakvome Bogu!? Dovoljan
je On u bezakonju i bestilaku. Ogoljeno:
naučno, neznalica istorijskih činjenica, politički odrpanac, karakterno
šićardžija. Svojom zaslugom, makar
najmljen, plaćen, nagnat spolja, ovjekovječio sa kao neprijatelj crnogorskoga
naroda/nacije i suverene države Crne Gore.
Dodajem: Odluku Utavnoga suda da odbije prijedloge za utvrđivanje ustavnosti
Temeljnoga ugovora i izmjena Zakona o slobodi vjeroispovijesti, Dritan Abazović
radosno pozdravlja: “kao lična
satisfakcija”.
